TERMS OF SERVICE

You must be at least 13 years old to use FitCrew. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using FitCrew you represent that you meet these requirements.

FitCrew provides general fitness, exercise, and nutrition information for educational and informational purposes only. It is not medical advice and is not a substitute for professional medical, nutritional, or dietetic care.

Consult a physician before beginning any exercise program or making changes to your diet, especially if you have a medical condition, are pregnant, or are taking medication. Exercise carries inherent risks, including injury. By using FitCrew, you acknowledge and voluntarily assume all risks associated with physical activity and dietary changes, and you agree that you are solely responsible for your own health and safety. Stop and seek medical attention if you experience pain, dizziness, or discomfort.

Calorie and macronutrient targets, diet-style presets, and similar features generate general guidance based on standard formulas and the information you provide. They are estimates, not personalized dietetic prescriptions, and do not create a coach–client or practitioner relationship. Consult a registered dietitian or physician for medical conditions or individualized dietary needs.

Food and nutrition lookups are powered by USDA FoodData Central, a public-domain database published by the U.S. Department of Agriculture, with Open Food Facts used as a fallback for foods it does not carry; the Open Food Facts database is made available under the Open Database License (ODbL). Both are third-party sources whose branded entries are supplied by manufacturers, and we do not warrant the accuracy or completeness of that data. Check the values against the product label before relying on them.

You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

You retain ownership of the content you post (workouts, photos, comments, and other materials, "User Content"). By posting, you grant FitCrew a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content solely to operate and promote the Service.

You agree not to post or do anything that:

• is unlawful, harassing, hateful, threatening, or abusive;
• is sexually explicit, or contains nudity — including in progress photos, which are for tracking physical change and must not show genitals, buttocks, or female nipples;
• infringes another person's intellectual property, privacy, or other rights;
• is spam, misleading, or promotes dangerous or unproven health practices;
• contains malware, or attempts to hack, scrape, or disrupt the Service;
• impersonates another person or misrepresents your affiliation.

These rules apply to private content as well as public — including progress photos, which nobody else can see. We may remove content or suspend or terminate accounts that violate these Terms, at our discretion.

The Service, including its design, software, and branding, is owned by FitCrew and protected by intellectual property laws. Exercise, food, and other reference data may be provided by third parties and remain the property of their respective owners. You may not copy, modify, or create derivative works from the Service except as expressly permitted.

FitCrew is free to use with optional paid features ("Pro"). Pricing and features may change. Where purchases are made through a third-party app store, that store's payment and refund policies also apply.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

Automatic deletion for inactivity. To keep the community free of abandoned accounts and empty groups, we automatically delete: (a) any account that has been inactive for 365 consecutive days(no app activity), along with its associated content; and (b) any member-created crew that has had no activity for 90 consecutive days (no messages or new members). Official FitCrew crews are exempt from automatic deletion. Before an account or a crew you created is deleted for inactivity, we will send an advance warning email to the address on file so you have the chance to keep it by returning to the app. See our Privacy Policy for details.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information (including nutrition or exercise data) is complete or accurate.

To the fullest extent permitted by law, FitCrew and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, loss of data, or loss of profits, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

You agree to indemnify and hold harmless FitCrew from any claims, damages, or expenses arising out of your use of the Service, your User Content, or your violation of these Terms or of any law or third-party right.

These Terms are governed by the laws of the United States and the state in which FitCrew is established, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located there, unless otherwise required by applicable law.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
